It also <strong>restricts<\/strong> the implementation of photovoltaics on <strong>irrigated land<\/strong> and <strong>strengthens territorial governance<\/strong> (Social Dialogue Tables and Sectoral Territorial Plan). <\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>BOOSTING ENERGY COMMUNITIES<\/u><\/strong><\/p>\n<p>Some of the <strong>new features<\/strong> included in the <strong>Decree-Law<\/strong> to <strong>promote energy communities<\/strong> are:<\/p>\n<ul>\n<li><strong>Public utility.<\/strong> <strong>Decree-Law<\/strong> 22\/2025 considers both <strong>renewable energy communities<\/strong> and <strong>citizen energy communities as energy communities<\/strong> in accordance with EU and national regulations, and <strong>declares them to be of public utility<\/strong> . This provides reinforced legal coverage to their projects. <\/li>\n<li><strong>Specific registration.<\/strong> The <strong>Registry of Energy Communities<\/strong> is created (dependent on the competent department for energy) and <strong>registration<\/strong> is done by <strong>responsible declaration<\/strong> , with the possibility of <strong>subsequent verification<\/strong> by the Administration.<\/li>\n<li><strong>Direct transfer of public spaces.<\/strong> Administrations and the public sector can <strong>directly establish<\/strong> <strong>surface rights, concessions or public domain authorizations<\/strong> in favor of energy communities when there is <strong>a general interest<\/strong> (key for roofs\/municipal land).<\/li>\n<li><strong>Procedural exemptions.<\/strong> <strong>Projects promoted by energy communities<\/strong> are <strong>exempt<\/strong> from the <strong>initial presentation act<\/strong> and the <strong>offer of local participation<\/strong> .<\/li>\n<li><strong>Municipal role and territorial impetus.<\/strong> The Decree-Law <strong>reinforces municipal powers<\/strong> in energy transition, including their <strong>participation in renewable energy communities and citizen energy communities<\/strong> , and <strong>provides the ICAEN with a territorial structure<\/strong> to <strong>support city councils and communities<\/strong> in the deployment of projects.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><u>ADDITIONAL MEASURES FOR ENERGY COMMUNITIES<\/u><\/strong><\/p>\n<p>Although this new Decree-Law represents a step forward, there is still room for <strong>additional improvements<\/strong> that the Generalitat can activate <strong>within its powers<\/strong> to accelerate the deployment of energy communities.<\/p>\n<p>In this sense, the <strong>Registry of Energy Communities<\/strong> and <strong>registration by responsible declaration<\/strong> <strong>require development<\/strong> that <strong>clarifies content<\/strong> .<\/p>\n<p>In the <strong>direct transfer of surface rights, concessions or authorizations<\/strong> in favor of energy communities, it will be necessary to develop the <strong>procedure<\/strong> , the <strong>criteria of &#8220;general interest&#8221;<\/strong> , the <strong>deadlines<\/strong> and the <strong>transparency\/concurrence<\/strong> .<\/p>\n<p>Under <strong>a local participation regime<\/strong> , it would be necessary to incorporate <strong>financial instruments<\/strong> <strong>adapted to energy communities<\/strong> (EC) (e.g., <strong>local microbonds<\/strong> or <strong>public guarantees<\/strong> ).<\/p>\n<p>Likewise, although <strong>the ICAEN is provided with a territorial structure<\/strong> and <strong>the role of the Business Management Office is strengthened<\/strong> , <strong>there is no<\/strong> specific <strong>\u201cCE window\u201d<\/strong> with <strong>comprehensive traceability of files<\/strong> ; creating one would help <strong>standardize criteria<\/strong> and <strong>shorten deadlines<\/strong> .<\/p>\n<p>Finally, the <strong>Sectoral Territorial Plan<\/strong> will set the <strong>municipal reception capacity<\/strong> in six months; <strong>it would be important to<\/strong> <strong>reserve quotas<\/strong> for projects promoted by <strong>energy communities (CE)<\/strong> .
