Last Friday, November 21, Ivan Hortigüela, INSTA lawyer, successfully defended his doctoral thesis, entitled “The prevention of illegal trafficking in plastic waste in Catalonia: compliance programs as a tool for prevention and criminal liability of legal entities”, obtaining the qualification of excellent “cum laude” unanimously by the Court.
This doctoral thesis has been developed jointly in the business area of INSTA and the Rovira i Virgili University, and is part of the Industrial Doctorate Plan of the Generalitat de Catalunya . The development of an Industrial Doctorate aims to promote the transfer of knowledge, combining academic research with practical application in a business or innovation environment.
In the development of this thesis, the phenomenon of illegal plastic waste trafficking has been studied from a legal perspective, dedicating special attention to the prevention of this phenomenon through regulatory compliance programs. The work focuses on criminal compliance programs as an instrument to prevent the commission of waste crimes and the criminal liability of legal entities, considering the relevance of these programs both from the regulatory field and through their practical application.
With the development of this work, INSTA incorporates into our range of services advice on the prevention of criminal risks in environmental matters within the corporate sphere, and the preparation of appropriate and individualized regulatory compliance programs for the end client and the nature of their activity.
